Terms of Service

AGREEMENT TO TERMS: These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and VandalPro ("Company," "we," "us," or "our"), concerning your access to and use of the VandalPro website and AI image generation services (collectively, the "Service").

BY ACCESSING OR USING OUR SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Account Requirements

  • You must be at least 13 years old to create an account.
  • Single Account: Each user may maintain only one (1) active account. Creating multiple accounts is strictly prohibited and may result in a permanent ban.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for safeguarding your password and for all activities that occur under your account.

Acceptable Use & Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Automation: Using any automated system, including "robots," "spiders," or "offline readers," to access the Service in a manner that sends more request messages to the VandalPro servers than a human can reasonably produce.
  • Exploitation: Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
  • Reverse Engineering: You may not decompile, reverse engineer, or attempt to extract the source code of the Service.

Intellectual Property Rights

Our Content

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of VandalPro and its licensors. The Service is protected by copyright, trademark, and other laws of Norway and foreign countries.

Ownership of Generations

Subject to your compliance with these Terms, you own the commercial rights to the images you generate using VandalPro. However, you grant VandalPro a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your generations for the purpose of operating, promoting, and improving the Service.

Subscription & Payments

  • Billing: Subscription fees for "Starter", "Pro", and "Studio" plans are billed in advance on a monthly basis.
  • Credits: Generation credits are reset monthly and do not rollover. Unused credits expire at the end of the billing cycle.
  • Cancellation: You may cancel your subscription at any time via your account settings. Cancellation will take effect at the end of the current billing period.
  • Refunds: All payments are non-refundable unless otherwise required by law. We do not provide refunds for partially used billing periods or unused credits.

Indemnification

You agree to defend, indemnify, and hold harmless VandalPro and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content generated or uploaded to the Service.

Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. VandalPro makes no warranties, whether express or implied, regarding the reliability, accuracy, or availability of the Service.

AI unpredictability: You acknowledge that AI models can be unpredictable and may generate content that is inaccurate, offensive, or biased. VandalPro is not liable for any damages arising from the use or reliance on AI-generated content.

To the maximum extent permitted by law, VandalPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

Legal Provisions

Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver: No waiver by VandalPro of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

Entire Agreement: These Terms and our Privacy Policy constitute the sole and entire agreement between you and VandalPro regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
